1 General Terms

1.1 Acceptance of Terms

These Terms govern your access to and use of the websites and mobile interfaces owned and operated by Kanaka, including www.kanaka.com and associated applications (“Website”).
By visiting or using the Website, registering for an account, or participating in any Kanaka survey or rewards activity, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our accompanying Privacy Policy, Cookie Policy, and Data Processing Addendum (collectively, the “Policies”).

If you do not agree, please discontinue use immediately.

1.2 Definitions

Term	Meaning
User	Any individual visiting or using Kanaka.com.
Member / Panelist	A registered participant in Kanaka’s survey and rewards program.
Client	A business or organization commissioning market-research studies through Kanaka.
Service Provider	Vendors, processors, and subcontractors supporting Kanaka’s operations.
We / Us / Our	Kanaka, operated by iMAD Research Inc.
You / Your	User or Member, as applicable.

1.3 Eligibility

You must be at least 16 years old (or the age of digital consent in your country if higher) to use this Website or join the Kanaka panel.        
By registering, you represent that you meet this requirement and have the capacity to enter a binding agreement.

1.4 Modifications

Kanaka may update these Terms at any time without prior notice. The latest version will be posted on this page with a revised date. Continued use after changes means you accept the updated Terms.

2 User Rights and Responsibilities

Access	View public content on the Website without registration.
Participation	Register and take part in eligible surveys for points and rewards.
Transparency	Request details about how your data is collected and used.
Opt-Out	Unsubscribe from emails or withdraw from the panel at any time.
Accessibility	Request content in alternative formats for equal access.

Notification	Receive notice of material changes to these Terms or Policies.

2.1 User Conduct

You agree not to:

• Use the Website for fraudulent or unlawful purposes;
• Create multiple or false accounts;
• Use automated tools (bots, scripts, VPN spoofing) to complete surveys;
• Interfere with system security or performance;
• Post, transmit, or share content that is offensive, harassing, or defamatory;
• Attempt to access other users’ data or restricted areas of the Website.

Violations may result in suspension, forfeiture of points, or termination of membership.

3 Intellectual Property

All Website content (text, graphics, logos, code, data, and surveys) is owned by Kanaka or its licensors and protected by copyright and trademark laws.
You may not copy, reproduce, modify, distribute, display, or create derivative works without written authorization.

4 Permitted and Prohibited Uses

Permitted:

• Access and use the Website for legitimate survey participation.
• Redeem earned rewards according to program rules.
• Clients accessing commissioned survey dashboards under contract.

Prohibited:

• Reverse engineering or code scraping.
• Attempting to bypass security mechanisms.
• Reselling survey links or panel access.
• Misrepresenting identity or survey eligibility.

5 Data Handling and Privacy

Kanaka complies with GDPR, CCPA/CPRA, LGPD, PIPEDA, APPI, and India’s DPDP Act.
Your data is processed in accordance with our Privacy Policy v3.0 and Data Processing Addendum v2.0.

• Clients act as Data Controllers; Kanaka acts as Processor for research projects.
• Survey responses are anonymized before client delivery unless you explicitly consent otherwise.
• You may contact privacy@kanaka.com to exercise access, correction, or deletion rights.

6 Liability and Indemnification

6.1 Disclaimer of Warranties

The Website and all services are provided “as is” and “as available.” Kanaka does not guarantee that access will be uninterrupted, error-free, or free from viruses or defects. All use is at your own risk.

6.2 Limitation of Liability

To the maximum extent permitted by law, Kanaka and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or participation in surveys.   
Total liability is limited to the value of rewards earned within the preceding 12 months.

6.3 Indemnification

You agree to indemnify and hold Kanaka, its directors, employees, and partners harmless from any claim resulting from your breach of these Terms or violation of law.

7 Dispute Resolution

7.1 Arbitration (U.S. Users)

Disputes shall be resolved by binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association (AAA). You waive the right to a jury trial or class action.

7.2 Global Users (U.K. / E.U.)

Users residing in the UK or EU may bring privacy or data complaints to their local data-protection authority under GDPR Article 77.

7.3 Governing Law

These Terms are governed by and construed under the laws of Delaware, USA, without regard to conflict-of-law principles.

7.4 Force Majeure

Kanaka is not liable for delays or failures caused by events beyond reasonable control (including natural disasters, pandemics, cyberattacks, or regulatory actions).

8 Additional Clauses

8.1 Rewards and Incentives

Reward points have no cash value until redeemed. Kanaka reserves the right to adjust or cancel points suspected to be fraudulent or earned in violation of these Terms. Reward programs may change without notice.

8.2 Mobile Applications

Mobile apps may request permissions (camera, location, notifications) to enable specific features. Permissions can be managed within device settings.

8.3 Third-Party Links

Kanaka may link to external websites (e.g., reward partners). We are not responsible for third-party content or policies. Use at your own risk.

8.4 Termination

Kanaka may suspend or terminate your account for violation of these Terms or inactivity over 24 months. Unredeemed points may be forfeited upon termination.

8.5 Accessibility

Kanaka aims to conform to WCAG 2.2 AA standards. Alternate formats (e.g., large print or screen-reader optimized documents) are available upon request at accessibility@kanaka.com.

8.6 Service-Specific Terms

Certain projects or apps may have additional terms (such as API use or beta testing). These will be presented at time of participation and form part of this agreement.
